تقرير المحكمة الدولية الخاصة بلبنان

التقرير السنوي الثالث 2011 - 2012
الموجز
ما تضطلع به المحكمة الخاصة بلبنان (المُشار إليها فيما يلي باسم "المحكمة") في نطاق اختصاصها من تحقيقٍ في أفعال مرتكبي الاعتداءات القاتلة التي وقعت في لبنان وملاحقةٍ لهم يشكل استجابة لتحد أوسع نطاقًا، أي في الاستعاضة عن بيئة ظنّ البعض فيها أن لهم حصانة من المسؤولية عن الاغتيال ببيئةٍ ينعم فيها الشعب اللبناني كله بالسلام والهدوء وفرص التقدّم التي تؤدي إليها تطبيق سيادة القانون.
ويتعيّن على كل المحاكم السعي إلى إثبات مصداقيتها وصونها. وينطبق ذلك بصورةٍ خاصة على المحكمة التي تعوّل على ثقة الشعب اللبناني والمجتمع الدولي لدعمها. فعلينا ألا نضطلع بولايتنا فحسب، بل علينا العمل حتى يظهر للعيان أننا نضطلع بها على نحو يضمن تحقيق العدالة وحماية حقوق المتهمين حمايةً كاملة مع الحرص على مصالح المتضررين. ومراعاةً منا دومًا للشرط المطلق الذي يقضي بإقامة محاكمة عادلة، علينا تفادي أي تأخير لا لزوم له. وقد أتاح تفاني موظفي المحكمة تذليل صعوبات مختلفة، بما فيها الصعوبات الملازمة لإجراءات تُقام في ظروفٍ اقتصاديةٍ قاسيةٍ وبثلاث لغاتٍ رسمية. ولكن لا بد من بذل المزيد من الجهود الحثيثة، لا سيما فيما يتعلّق بضمان توقيف المتهمين.

Security Council Keeps Arms Embargo on Libya, Terminates Authorization to Inspect Cargo

This draft resolution aims to terminate the authorization granted to Member States to inspect vessels and aircraft bound to or from Libya, and to lift sanctions on Libyan Investment Authority (LIA) and Libyan African Investment Portfolio (LAIP).
The draft that is in blue now, extends UNSMIL's mandate for 12 months and calls upon the Libyan authorities to promote and protect human rights. 

The UK drafted this text and it is most likely to be adopted on Monday, March 12.

PP1. Recalling its resolutions 1970 (2011) of 26 February 2011, 1973 (2011) of 17 March 2011, 2009 (2011) of 16 September 2011, 2016 (2011) of 27 October 2011, 2017 (2011) of 31 October 2011 and 2022 (2011) of 2 December 2011,
PP2. Reaffirming its strong commitment to the sovereignty, independence, territorial integrity and national unity of Libya,
PP3. Reaffirming its resolutions 1674 (2006) and 1894 (2009) on the protection of civilians in armed conflict, 1612 (2005), 1882 (2009), and 1998 (2011) on children in armed conflict, and 1325 (2000), 1820 (2008), 1888 (2009), 1889 (2009), and 1960 (2010) on women, peace and security,

Security Council Statement on Sudan

Presidential Statement on the Security Council meeting on Sudan delivered by Mark Lyall Grant, President of the Security Council and Permanent Representative of the UK Mission to the UN – 6 March 2012

"The Security Council expresses grave concern about reports of repeated incidents of cross-border violence between Sudan and South Sudan, including troop movements, support to proxy forces, and aerial bombardments, and views the situation as a serious threat to international peace and security.  The Council urges the two countries to implement and respect the letter and spirit of their February 10 Memorandum of Understanding on Non-Aggression and Cooperation, which was agreed under the auspices of the AU High-level Implementation Panel (AUHIP).

American Draft Resolution on Syria

Diplomats say that this is the American draft resolution on Syria in the UN Security Council. It hasn't been officially circulated in the Council, but it's been under discussion between capitals and missions in New York. 
P5 members and Morocco discussed this draft on 6, 7 and 8 of March. 
"These discussions are just the beginning and will continue" the American Ambassador Susan Rice said in a statement on Tuesday, March 6. She added "if and when, it seems there is a basis for a meaningful and viable text, we will propose one to the full Security Council". 
"The parties have not reached a common ground on this draft", a diplomat said on Friday, March 9. 

"The Security Council,
       Noting that the present situation in Syria increasingly threatens international peace and security and is likely to further deteriorate unless there is a peaceful political solution,
       Expressing grave concern at the serious human rights crisis and the deplorable humanitarian situation especially in areas of fighting,
       Recalling its presidential statement of 3 August 2011, General Assembly resolutions A/RES/66/253 of 16 February 2012 and A/RES/66/176 of 19 December 2011, as well as Human Rights Council resolutions S/16-1, S/17-1 and S/18-1, and the Report of the Independent International Commission of Inquiry A/HRC/ 19/69,
       Reaffirming its strong commitment to the sovereignty, independence, unity and territorial integrity of Syria,
       Recalling the decisions of the League of Arab States, supporting all diplomatic efforts aimed at addressing the crisis, in particular those of the League of Arab States and the Secretary-General, and welcoming the appointment of the Joint Special Envoy for the United Nations and the League of Arab States, as part of the continuing efforts aimed at immediately bringing an end to all violence and human rights violations, and promoting a peaceful solution to the Syrian crisis,
OP 1 Demands an immediate halt to all forms of violence in Syria;
OP2     Condemns the continued widespread, systematic, and gross violations of human rights and fundamental freedoms by the Syrian authorities and demands that the Syrian government immediately put an end to such violations, and calls for those responsible for these violations to be held accountable;
OP3    Demands that the Syrian Government, in accordance with the Plan of Action of the League of Arab States of 2 November 2011, immediately:
  • (a) cease all violence and protect its population;   
  • (b) release all persons detained arbitrarily due to the recent incidents;
  • (c) withdraw all Syrian military and armed forces from cities and towns, and return them to their original home barracks;
  • (d) allow full and unhindered access and movement for all relevant League of Arab States’ institutions and Arab and international media in all parts of Syria to determine the truth about the situation on the ground and monitor the incidents taking place;
OP4    Calls upon the armed elements of the Syrian opposition to refrain from all violence immediately upon implementation of paragraph 3 of this resolution;
OP5  Fully supports the role of the United Nations and the League of Arab States in facilitating a Syrian-led political transition to a democratic, plural political system, in which citizens are equal regardless of their affiliations or ethnicities or beliefs, including through commencing a serious political dialogue between the Syrian government and the whole spectrum of the Syrian opposition;
OP6   Deplores the rapidly deteriorating humanitarian situation, in particular the growing number of affected civilians, the lack of safe access to adequate medical services, and food shortages, particularly in areas affected by fighting;
OP7   Demands that the Syrian authorities immediately allow unhindered humanitarian access  for all populations in need of assistance, and calls upon the Syrian government to cooperate fully with the United Nations and other humanitarian organizations to facilitate the provision of humanitarian assistance;
OP8    Requests the Joint Special Envoy to work with the Syrian government, other parties in Syria, and members states, towards  the full implementation of this resolution, and requests the Secretary-General to report on the implementation of this resolution within 14 days;
OP9    Decides to review the implementation of this resolution within 14 days and, in the event of non-compliance, to consider swiftly further measures;
OP10  Decides to remain actively seized of the matter."

شكوى خليجية في الأمم المتحدة ضد إيران

اتهمت دول مجلس التعاون الخليجي إيران "بالتدخل في شؤونها الداخلية وتعزيز النزاعات الطائفية في الدول العربية". وقالت في شكوى ضد إيران الى الأمانة العامة للأمم المتحدة ورئاسة مجلس الأمن إن وجود قوات درع الجزيرة في البحرين "قانوني عملاً بالاتفاقات الموقعة بين دول مجلس التعاون بما فيها البحرين". 
وتولت السعودية تسليم الشكوى باسم دول مجلس التعاون.

Syrian Compliant Letter Against Saudi Arabia, Qatar and AL

Sir,
            Ever since the events began, the Syrian Arab Republic has affirmed that armed groups are killing innocent persons in order to arouse citizens’ sentiments and make cheap gains at the regional and international levels. However, the parties that were responsible for arming those groups have denied this ever since the events in Syria began. The use of arms by those groups has resulted in the death of more than 2,000 Syrian law enforcement officials and the destruction and burning of dozens of public and private facilities, as well as oil and gas pipelines and railway cars.

Mr. President, 
Excellencies, 
Ladies and Gentlemen, 
I am making this report as requested by the General Assembly resolution A/Res/66/263 of 16 February. Given the gravity of the situation, please be assured that we will keep you regularly informed. We have all watched the events in Syria this week with growing alarm. 
We have seen heavy artillery shelling and tank fire in densely populated neighborhoods across the country. A major assault on Homs took place yesterday. Civilian losses have clearly been heavy. We continue to receive grisly reports of summary executions, arbitrary detentions and torture.
